Please read this agreement carefully before accessing or using the information and services available through the FashionCareers website ("Site"). By accessing or using the Site, you agree to be bound by the terms and conditions below. FashionCareers may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Site. Advertiser terms and conditions must be accepted and adhered to by Advertisers who use FashionCareers's services and the Site. FashionCareers also has a comprehensive privacy policy for users of the Site.

Copyright and trademarks

Copyright in the material and trademarks on this Site are owned by FashionCareers ABN 88 308 476 818 ("FashionCareers") unless otherwise indicated and you agree not to infringe any intellectual property rights owned by FashionCareers.

Information for personal, non-commercial use only

You agree that information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose (this includes but is not limited to the use of Advertiser contact details for unsolicited commercial correspondence). You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this Site including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.

You may not use data mining, robots, screen scraping, or similar data gathering and extraction tools on this Site for establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication, except with our prior written consent.

Information does not represent professional advice

You acknowledge and agree that information published by FashionCareers is intended to provide general information in summary form on legal and other issues.

FashionCareers does not endorse or recommend any of the jobs, business or self-employment opportunities advertised on its Site and FashionCareers strongly recommends that prior to entering into any agreement with any of the Advertisers on the Site, that you obtain your own independent legal, accounting, financial or taxation advice as appropriate. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Site or on the Internet generally.

In no event will FashionCareers be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.

No guarantees of job vacancy

FashionCareers gives no guarantee to you of the continued availability of any particular job advertised on the Site and will not be liable to you should an advertiser have filled the vacancy at any time prior to removal of the advertisement from the Site.

Whilst FashionCareers takes efforts to ensure that jobs advertised are for actual job vacancies, it gives no guarantee to you that every job advertisement represents an actual job vacancy.

No guarantees or endorsements of sites or services we link to or that link to us

FashionCareers provides links and pointers to Internet sites maintained by third parties from its Site. Such linked sites are not under the control of FashionCareers and FashionCareers is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site. FashionCareers is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by FashionCareers of the linked site. FashionCareers is not responsible for the copyright compliance of any linked site. FashionCareers will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party service provided by any third party.

No guarantees as to the service

FashionCareers provides no warranty to you that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that FashionCareers cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

Our rights to use information you send us

FashionCareers welcomes ideas and feedback from you about all aspects of the Site. You agree that FashionCareers may reproduce, distribute, transmit, create derivative works of, and publicly display any materials and other information (including ideas for new or improved products and services) that you submit to any public areas of the Site (such as bulletin boards, forums and newsgroups) or by email to FashionCareers. No guarantees as to security of your information

While FashionCareers takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on FashionCareers systems or on FashionCareers's Site. FashionCareers disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

Your responsibility for your password and login

To become a registered user, you must provide a password and a login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password at any time by following instructions. You may also change your login by contacting customer service.

You agree to immediately notify FashionCareers of any unauthorized use of your login name or any other breach of security known to you.

No misrepresentations allowed

You agree that it is a condition on your use of any services provided by FashionCareers or through the Site that you will not either through any act (including but not limited to posting a resume or job advertisement on the FashionCareers Site) or omission mislead or deceive others.

Advertiser Terms and Conditions

Advertisers on the FashionCareers Site agree to be bound by the following terms and conditions:

  1. You will be solely responsible for the contents and materials contained in all your advertisements.
  2. You shall not post any incomplete, false or inaccurate information about your advertisement.
  3. You shall not post any offensive, misleading or illegal content or content that promotes such activities such as copyright violations, pornography, bigotry, hatred, harassment, promotion of physical and psychological harm, criminal activity, etc.
  4. You must ensure that all advertisements posted to the Site comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct, including but not limited to the:
    1. Competition and Consumer Act 2010 (Cth) including but not limited to section 31 of Schedule 2 which requires that if you are a company you must not mislead persons seeking employment as to the availability, nature, terms or conditions or, any other matter relating to the employment opportunity being offered; and
    2. Fair Trading Acts in all applicable States and Territories; and
    3. Privacy Act 1988 (Cth) including the National Privacy Principles; and
    4. Estate Agents Acts in all applicable States and Territories; and
    5. Human Rights and Equal Opportunity Commission Act 1986 (Cth) and all anti-discrimination and equal opportunity legislation applicable in the State or Territory in which you do business.
  5. You must adhere to the principles of truth in advertising set out in the RCSA's code of Practice.
  6. Whilst FashionCareers does not review every advertisement posted on the Site, it reserves the right to withdraw without notice to the Advertiser any advertisement that is or appears to FashionCareers to be contrary to law. Further, FashionCareers reserves the right to either reject or remove any advertisement from the Site for any reason whatsoever.
  7. You agree to indemnify FashionCareers its directors, officers, employees, agents and any other members of FashionCareers against all claims, actions, suits, liabilities, costs and expenses incurred on any account by FashionCareers as a result of the listing or proposed listing of any advertisement by an advertiser on the Site.
  8. You agree to keep FashionCareers, its directors, officers, employees and agents fully indemnified against any actual or contingent costs, expenses, charges, damages or liabilities incurred in relation to any actions or claims brought by any person or entity against FashionCareers as a result of an actual or alleged breach by you of any law, regulation, by-law, ordinance or code of conduct or such other actions or claims brought as a consequence of your advertisement appearing on the Site.
  9. FashionCareers accepts no responsibility or liability for any errors in your advertisements and you must check your advertisements for errors as soon as they are placed on the Site. FashionCareers agrees to use reasonable efforts to publish advertisements in the shortest possible time. However, FashionCareers is not liable for any loss or damage incurred by an Advertiser as a result of any failure or delay in listing an advertisement.
  10. FashionCareers acts as a medium through which individuals seek employment opportunities. FashionCareers does not vet, nor is it responsible for vetting, job candidates or the representations made by them whether oral or in writing - including those representations appearing in job candidates resumes.
  11. Standard job advertisements are valid for 30 days, although you can choose to expire the advertisement earlier.
  12. All amounts owing to FashionCareers must be paid within 14 days of the date of invoice.
  13. You are obliged to pay for the services that FashionCareers agrees to provide you with regardless of whether you utilise or fully utilise those services. If you do not provide FashionCareers with the necessary materials or information for FashionCareers to deliver these services to you, you are still liable to FashionCareers for full payment.

General provisions

If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.

Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.

The laws governing this agreement will be the laws in Victoria, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in Victoria.

For the purposes of this agreement the words "FashionCareers", "We", "Our" and "Us" refer to FashionCareers and "Site" to materials delivered on www.fashioncareers.com.au and other co-branded versions of the site.
